1. What Information is Collected and How We Collect It
- Information You Provide. We collect information in several ways. When you use our Site, we collect personal information about you and your loved ones that you affirmatively provide to us, including in the following ways.
- Registration and Account Information. When you create an account, we ask you for your first and last name and email address.
- Communications. If you contact us directly, we receive information about you or your loved one that you choose to provide. For example, when you request a quote, we ask you for your name, email address, phone number, and zipcode. We may also ask you for your or your loved one’s birth date, weight, medical information, and other information that may be necessary to facilitate our Services depending on your needs. You may also provide your phone number and/or email address in order to be contacted by Earth. We also collect personal information in other ways, such as when you contact us by email, traditional mail, and/or telephone.
- Registration and Account Information. When you create an account, we ask you for your first and last name and email address.
- Information Provided by Others. In some instances, we collect certain user data and other usage information via a third party service provider. Such information will be subject to this Privacy Policy but may also be subject to the third party’s own privacy policies. To facilitate and market our Services, we may receive the following categories of personal data about you from third-parties: financial information, professional and education history, certain demographic information, household characteristics, purchasing tendencies, and other individual preferences and characteristics.
2. Information We Collect When You Use Our Services
- Location Information. When you use our Services, we receive your location information. For example, we infer your general location information by using your IP address.
- Device Information. We receive information about the device and software you use to access our Services, including IP address, device type, device identifiers, web browser type and version, operating system version.
- Usage Information. We automatically receive information about your interactions with our Services, like the pages or other content you view, referrer information (the website you visited before coming to our Services), the dates and times of your visits, the searches you conduct, and the products and services you purchase.
- Obituaries and Notes. As part of our Services, we may provide obituaries on our Site where family members and friends can post heartfelt messages and photos. You must be logged into your Earth account in order to post content on obituaries, to like or “heart” notes, or to subscribe to an obituary’s updates. When you post a note, your first and last name will always be viewable by other users. The content you post to an obituary will be displayed on our Site and will be viewable by other users by default. Other users also have the ability to share your notes online. We are not responsible for the other users’ use of available information, so you should carefully consider whether and what to post or how you identify yourself on the Site.
- Reviews. As part of our Services, you have the option to post reviews of our Services, either directly on our Site or through Google Reviews. When you post a review, your first name, last name initial, the county and state where you are located, and date of the review will always be included with your review. By default, your reviews are publicly visible on our Site, and anyone on our Site can view them. If you post a review using a third-party platform, the privacy policies and terms of those platforms govern your use of those platforms.
- Call Recordings. To provide and improve our Services, we and third-party service providers on our behalf record inbound and outbound calls.
- Information from Cookies and Other Tracking Technologies. We and our third-party partners collect information about your activities on our Services using cookies, pixel tags, SDKs, or other tracking technologies. Our third-party partners, such as analytics, advertising, and security partners, may also use these technologies to collect information about your online activities over time and across different services. Cookies are pieces of information placed in the settings of your web browser by a website server to identify your computer when you return to a website. Whenever a site welcomes you and tailors data to your specifications, it is reading a cookie left in your browser and identifying information that you may have registered during previous visits, such as your viewing preferences. Because the providers of Do-Not-Track and similar signals do not yet operate according to common, industry-accepted standards, we currently do not respond to those signals. - Payment Information. The safety of your credit card information is important to us, and Earth makes commercially reasonable efforts to help securely process the information you provide. We collect your payment information when you participate in our pre-payment plan. We also use companies specialized in collecting and processing your payment information, including Stripe (“Payment Processors”). If you choose to make a payment, please be aware that these Payment Processors are not affiliated with Earth, but they do adhere to their own privacy policies, which may be found on their respective websites. Please review the relevant privacy policy prior to providing your credit card information.
3. How We Use the Collected Information
When you provide us with personally identifiable information, we may use that information to provide, maintain, improve, and enhance our Services, to understand and analyze how you use our Services and develop new products, services, features, and functionality; to communicate with you (such as to notify you about updates to our websites, send you special offers, promotions, provide information that you request, respond to comments and questions, and otherwise provide customer support), and to contact you for marketing purposes. In order to improve your customer experience, your information is shared with third party service providers we use to maintain the Site or to process transactions and order information, including Stripe.com, which is our credit card processing company. We disclose personal information as reasonably necessary to operate our Services, such as in connection with providing requested services to you.

- Other Third Parties. In an ongoing effort to better understand our customers, we receive information from third parties to carry out, maintain, manage, and improve operations in connection with our Services. For example, we may share personal information to facilitate conversion tracking.

- Advertising Partners. We may share your information with key partners and affiliates whose merchandise and services we believe are of interest to you. We have contractual relationships with all such partners and affiliates that require them to safeguard your information and allow you to opt out of receiving further information from them. Some of our advertising partners are members of the Network Advertising Initiative (https://optout.networkadvertising.org) or the Digital Advertising Alliance (https://optout.aboutads.info) and serve ads through cookie-based technologies. 9. Miscellaneous
- Children’s Access. The Site is a general audience website, intended for adult use. Earth does not market to, and does not knowingly collect any personally identifiable information from children under sixteen (16) years of age. - Third-Party Links. While you are using this Site, you may be linked or directed to other third party sites outside of the Site that are beyond our control.
